Terms of Service
The terms governing your use of TrueStake — a read-only staking-analytics and tax-reporting tool. TrueStake provides records and computations, not tax, legal, or investment advice, and never takes custody of funds.
Preliminary version — pending final legal review. We've published these Terms early for transparency while we complete a final review with legal counsel. They reflect how TrueStake actually operates today; some provisions (notably the formal dispute-resolution terms in section 13) will be refined in the final version. Questions: support@truestake.io.
1. Agreement
These Terms govern your access to and use of TrueStake (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. What the Service is — and is not
TrueStake is a read-only analytics and tax-reporting tool. It derives a reconciled, timestamped record of your Ethereum staking rewards from public on-chain data and produces exports (XLSX/CSV) you can use for your own record-keeping and tax preparation.
The Service is not, and does not provide:
- Tax, legal, or investment advice. TrueStake performs computations and produces records from public on-chain data. It does not advise you on your tax position, prepare or file your return, represent you before any tax authority, or opine on the correct tax treatment of any transaction. You are responsible for your own filings and should consult a qualified tax professional.
- Custody or financial services. TrueStake never takes custody of ETH or any asset, cannot move funds, and is not a broker, exchange, money transmitter, custodian, or registered investment adviser.
- A KYC or identity service. We do not collect government identification or exchange credentials. See our data-minimization standard.
3. Eligibility and accounts
You must be at least 18 and capable of forming a binding contract. You are responsible for safeguarding your authentication credentials (email + passkey) and for all activity under your account. Notify us promptly of any unauthorized use at support@truestake.io.
4. Accuracy and "as is" nature of outputs
TrueStake reconciles derived rewards against on-chain receipts to a wei-level tolerance and cites its sources, but outputs depend on the accuracy and availability of third-party data sources (the Ethereum consensus and execution layers, price feeds, and infrastructure vendors). Outputs are provided for your review and are not a guarantee of tax outcomes or of completeness. You are responsible for verifying outputs before relying on them for any filing or financial decision.
5. Acceptable use
You agree not to: (a) access the Service other than through the interfaces we provide; (b) reverse engineer, scrape, or overload the Service; (c) attempt to access data that is not yours; (d) upload another person's validator data without authorization; or (e) use the Service to violate any law.
6. Payment
Paid plans, when offered, are billed through Stripe under the plan terms presented at checkout. As of this version, billing is not enabled for general users. When paid plans launch, the applicable pricing, renewal, and cancellation terms will be presented to you before you subscribe.
7. Intellectual property
The Service, its software, and its content (excluding your data and public on-chain data) are owned by TrueStake and protected by intellectual-property laws. You retain your own data; you grant us only the limited license needed to operate the Service and deliver your outputs to you.
8. Third-party services
The Service integrates third-party sub-processors (see the Privacy Policy and our public Sub-Processor Disclosure). We are not responsible for third-party services' own acts, omissions, or availability.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS ARE ERROR-FREE OR SUITABLE FOR ANY TAX OR FINANCIAL PURPOSE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUESTAKE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY TAX, PENALTY, OR FINANCIAL LOSS ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ITS OUTPUTS.
11. Termination
You may stop using the Service and request account deletion at any time. We may suspend or terminate access for violation of these Terms or to comply with law. Provisions that by their nature should survive termination (e.g., disclaimers, limitation of liability, intellectual property) survive.
12. Governing law and disputes
These Terms are governed by the laws of the United States and, to the extent applicable, the state in which TrueStake is operated, without regard to conflict-of-laws rules. If you have a concern, please contact us first at support@truestake.io so we can try to resolve it directly. We are finalizing our formal dispute-resolution terms (including venue and any arbitration provisions) with counsel and will update this section when that review is complete.
13. Changes to these Terms
We may update these Terms and will post the revised version here with an updated "Effective" date. Material changes will be communicated to account holders by email. Continued use after changes take effect constitutes acceptance.
